Hi - I finished my trust deed 3 years ago this month. I thought my credit record would be blemished for 6 years from this date but I checked today and it seems that all, except one creditor, have removed themselves from my record. This is good. However, the remaining creditor, Northern Rock, has put the following: Payment received as a full and final settlement although the payment would not fully clear the balance. How can they receive something in 'full and final' yet put this on my record? Is there anything I can do about this. Any help appreciated. Thanks.

I assume that this was a debt in your trust deed?

Was there a default notice issued on it?

Hi, thanks. Yes it was a debt in my TD. I'm not sure about the default notice? Where would I be able to establish whether it was or not? On my credit record or?

It should be on your credit record fabfour.

Either way the balance should be set to zero at the time that you were discharged.

If a default notice was issued it should have been marked as being either "satisfied" or "partially satisfied".

The marking of "partially satisfied" sounds similar to the one that you have on there - an indication that the account is settled albeit without the full balance having been repaid.

The default date is 1 august 2011 and the status is 'settled' date satisfied is 8 12 2011 and the note I've quoted in my original post is under a bit which says 'customer account update'. Are they allowed to say that? Should this not now be removed from my record? I wonder why others have removed and not them (though I appreciate it is correct, it was partially satisfied).

Anything that goes on your credit file will stay there for a period of six years fabfour.

I think if they've reported information that's accurate and correctly timed you might be on shaky ground in terms of asking it to be removed.

That doesn't stop you from asking them about this if you want to though.

oops, though it does say zero next to 'current balance' so that's probably correct

Thanks. Just so I'm clear, does that mean that it might be on there for another 3 years? I wonder why the others have removed their info.

Chances are that you defaulted on them over six years ago as they disappear automatically after that time. Can you remember when you defaulted on the agreements?

Hi fabfour.

The default notice should be timed at the start of your trust deed, not upon your discharge. I've just realised that I overlooked that from your previous posts.

From what you've written I think you might have grounds to request that the creditor change that date back.

This, in itself, should result in the entry vanishing from your credit file years sooner.

I'm really grateful for that confirmation. I wondered if it might be the case as I couldn't see the others removing their entries unless they had to. I will get in touch with the agency and the NR to try and get this removed.
