Hi,
Does anyone know if your credit file is updated when in a Trust Deed or does it just look like you have defaulted on payments and is only updated when the Trust Deed is complete and payments distributed?
Thanks...
Hi Buzzbee
It depends what exactly you mean.
Your credit report will show that you entered a trust deed on the date it was signed. I think the AIB lodges this information.
It is then updated to show when you have completed it. Again I think it is updated by the AIB. That information was correct and fast in being recorded on my record.
In the meantime, during your Trust Deed your individual creditors will show Red DeFaults each month until they receive their payment, at which point mine shows PS (partially settled) in the monthly payment record.
The individual creditors will also mark the topline of the information with a date which should reflect the date the Trust Deed was signed. However, this is not always accurate and can be some months out.
When your Trust Deed is concluded and you receive your Form 5 discharge, you can use that to contact the creditors and ask that they update their files to show the correct initial Default Date.
That is important since it is 6 years from that date that is removed from your credit record.
The default is removed after 6 years from Trust Deed signing, so depending when you finish your payments you should have some time to check and write to your Creditors to correct any discrepancies. (From experience, if they are within a month from Default/signing date, I would not waste the time, money and energy trying to get it changed. It took me 6 months, several calls and letters to each).
The ICO (information commissioner office) advised me that the monthly Red Circle Defaults should also disappear when the creditor's record drops off at six years. If for any reason it does not, then we contact the creditor and ask that it is corrected. If it is not corrected, you can contact the ICO for their help in having it corrected. Again, that takes time. However, the ICO were clear in their answer to me that it should disappear.
I also received a reply from Noddle (free credit report company) that stated it should disappear and no Red Circle monthly Defaults should appear. This matched the ICO response.
Hope that is clear and it helps.
Thanks Firewalker....lots of good info and answered what I needed to know.
