Hi, I received my form 5 in January. I checked out my credit file recently and it states that the trust deed is still active.

Can you please let me know how I should arrange for my credit file to be cleaned up and my status changed to show that I have completed my trust deed?

Have you logged on to the AIB website to see if it shows that you are showing as discharged? They were very fast updating mine (a week if I remember correctly). It seems strange that it is still showing after a few months.

Is it only on one Credit Reference company? Or all of them? You can use www.Checkmyfile.co.uk on a free month trial If you want to get an idea what all the reference agencies are listing. Remember to cancel if you don't want to continue at ยฃ7.99 per month. Or you can pay ยฃ2 each to send for a copy of your credit reference files.

As for the individual accounts, there is no rush to update them since the Trust Deed will show on your Credit Report for 6 years from the date of signing. However, you can contact the companies by phone or write and provide them with a copy of your Form 5 discharge. Sometimes it can take a bit of time to get the correct department to action things and you may have to be prepared to chase them a bit; some are better than others.

I am curious to know if the AIB website shows you as discharged. If so, you can ask the AIB to have it corrected. If that does not work, contact the credit reference agencies and give them a copy/snip/reference from the AIB and ask them to correct the entry.

Best to identify what's on there that you're unsure about and then deal with each matter specifically.

Thanks for replying. The thing is, I'm not sure what my credit report is supposed to state.

Firewalker - I went onto checkmyfile and the creditors who were included in my TD are showing as defaulted. I plan on sending a copy of my form 5 to experian, equIraq and call credit for my records to be updated accordingly. I hope this helps to getting the information accurate at least.

The discharge has not been entered as AIB. The Form 5 was sent to me in January.

Hi PrenticeBaby.

May I make a suggestion:

Contact your Trustee to advise that the AIB are not showing as discharged. they should either sort it out with the AIB or send the form to AIB.

Depending on what the Trustee says, if you do not get any satisfaction there, contact the AIB with a copy of form 5 and ask them to update your file. If they are satisfied you are discharged, they should also update your Credit Reference File automatically.

I doubt that the Credit Reference Agencies will update your file based on your Form 5. They will generally act on the instructions of Creditors or the AIB. They may however, take your form 5 and liaise with them as a dispute. Especially if the Trust Deed is not showing as discharged on credit reference files.

I personally think the first thing is to get the AIB file updated.

When all that is done - contact the creditors directly, provide them with a copy of the Form 5 and ask them to mark your file as Satisfied or Partially Satisfied and to change the defaulted date to the date the Trust Deed was signed.

You are only recently discharged so please remember you have quite a time to get everything corrected so there is no panic or rush.

The credit reference agencies will use the official register (the Register of Insolvencies) to update their records of the completion of trust deeds. Discharge isn't official until the Form 5 is registered on the Register of Insolvencies, so technically prenticebaby you may not currently be discharged. As Firewalker suggests, this needs to be resolved with your trustee.

There's probably not much you can do about individual creditors until the official register has been updated I'm afraid.
