hi there new to forum hopefully someone can advise, signed trust deed on 1st of feb 2011 has just became protected, i received coucil tax bill for feb 2nd until end of march 2011 however all my arrears of council tax including 2010/11 are included in my ptd.spoke to council who said i have to pay 226.00 as this is after trust deed was signed! confused? you bet i am. incidentally i have set up dd for new council tax year which of course i will pay. any thoughts?

Welcome to the trust deed forum bankiestillidie.

I think you'll need to pay this bill I'm afraid. A trust deed deals with the debts that you had at the time of signing rather than future liabilities. The amount on this bill didn't constitute arrears at the time of signing.
Best to wait for confirmation on this from one of the others though.

Yes, I'm afraid that this is correct - you are liable for the charge due for the period after the signing of the trust deed

thanks for the welcome tda, as regards your answer the bill for feb and mar 2011 is included in the amount of ctax arrears that my ip was given.dont see why i should have to pay it.the whole amount for 2010/11 was included in arrears that i had with scott and company.so tda feb and mar this year has been included by them in my total arrears.

I think you were being chased for it (the bit from the date you signed the trust deed) because the council was no longer accepting installments from you bankiestillidie.

However the amount you have received a bill for, from the date that you signed the trust deed, remains your responsibility to pay in the usual way I would think.

Your trust deed should have included provision for you to pay your council tax each month from the point of signing (in the income and expenditure analysis used to work out your monthly trust deed payment) so this doesn't seem unreasonable.

ah well small price to pay. thanks tda and kevin for your advice. council had indicated to me when i spoke re this that they can incorporate what i owe into the new ctax monthly payments i have.another 19 quid a month isnt too bad. great forum btw![:)]
