Hi there folks ! Had to lodge answers to sheriff deputy clerk in opposition to my trustdeed being reopened to claim my PPI settlement! Was wondering if anyone had info on how does the process go now and how quickly!? Also what kind of fees could I be expected to cough up ? Thankyou G SCULLION

Hi gscullion1977,

How much is the potential PPI refund?

I'm not sure how much it will cost you should you appoint a solicitor to deal with the issue of defending you on reopening the Trust Deed. This is something which you would need to speak directly to a solicitor about. The best thing to do is try and speak with a solicitor who has experience dealing with Insolvency legislation.

I'm limited to what I can tell you about the process as it's not something which I have any experience in dealing with. You should speak with a solicitor about it as a matter of urgency though.

Hi gscullion1977,

I wish you the very best of luck in your battle to stop your TD being reopened, as a matter of interest, did you receive a detailed letter from Clydesdale Bank about your PPI complaint explaining the findings of the investigation and the decision made, with an offer of compensation and an acceptance letter at the end for you to sign and return. Or did it tell you the amount you were due and that it would be getting sent to your former trustee? I only ask as I may be finding myself in the same situation very shortly with Clydesdale Bank.

Thank you in advance

Hi mate! That's exactly what happened after fighting for the PPI claim for over 2 years with countless phonecalls and about a hundred letters never once was the trustdeed mentioned or involved!the final settlement letter telling me the amount was the first time I was told it was being handed to the trustee! I hope this is helpful mate! GS

Have you looked into whether there any free law centres in your area that may be able to help?

A good suggestion Kevin.

You want to try and act as quickly as possible investigating any free law centres in your area gscullion1977. If you do have one in your area and they can help then the more time you can give them to prepare for your hearing the better.

Let us know how you get on.

Hi David and Kevin thankyou for advice! Was hoping you might be able to explain one other issue for me? The court appointment is for a procedural hearing, could you explain to me what exactly this involves and what I need to have with me on the day ! I would greatly appreciate any help you could provide me! Thanks again! G scullion

Hi,

This is something which you really need to speak with a solicitor regarding. This is more of a legal question which I'm not qualified in.

Sorry I can't be of more assistance.
