This is my first time posting but I can't seem to get an answer anywhere (particularly from my trustee).
Does being in a PTD exclude me from being a director of a Scottish company? I also went through a business insolvency at the time I set up the PTD.

Hi Lori

This was asked yesterday.

No it does not stop you from being a Director of a Ltd company.

Mark

Mark is not posting regularly in the Trust-deed.co.uk forum.

Hi Lori and welcome to the trust deed forum.

Years ago I tried to research the same question online. About 50% of the websites I visited said "yes" and 50% said "no"!!

As Mark has said you can be a director. You may need to check the articles of association of the company just to confirm that it's OK by the rules of that company specifically.

Hi Lori

You can not be a director at the time of entering the trust deed. This is what I was told. Once you are in the trust deed it is possible!
I would check that there are no references to this in the companies articles of association.

Hi Bowershall.

Depending upon the circumstances there may be a couple of steps that need to be taken for a current Director to continue as a Director after a trust deed is signed.

This is usually perfectly manageable though, it just needs thinking through in advance with the help of the adviser.
