Can you tell me if it is posible to add further debts to my PTD.
The debt is not new and existed when I entered into the PTD.
I had an unsecured portion with my mortgage, which i completely forgot about at the time I entered into the PTD. I recently got my mortgage statement and for the first time it had broken the mortgage into secured and unsecured.
My house is still in negative equity even with the unsecured portion of the mortgage removed. Although I should be able to increase my payments, as if this debt was added to the PTD then my mortgage payments would lower.

Hi Poorboy.
You should certainly speak with your trust deed firm about this. In some instances there might be a concern if a large debt were later added to the trust deed (because it would reduce the return that the other creditors would get) but hopefully your increased monthly payment will mitigate against that.

I would agree with TDA. Talk with your Trustee, it may be possible. Your mortgage company will have been written to at the outset, so it is not as though they didn't know about the Trust Deed. They could have volunteered the information at that point!! Is your mortgage in joint names? If it is, your partner will be expected to make the payments on the unsecured loan with the mortgage lender.

The mortgage is solely in my name, although my partner and I have gotten married since the mortgage was taken out. Does being married make her in any way liable, even though it is solely in my name?
My wife is also in a PTD.

Thanks for the advice Shona and TDA.
I spoke to my Trustee and they were happy to add the additional debt to by PTD.
I will be making increased payments, but not until February as the Trustee thinks it may take a few months to completely sort and with the payment being taken as one Direct Debit with my mortgage I can't just cancel it like I could do with the others.
The outcome was better than I had hoped for.
