Can ex bankrupt sign TD

Hi all, a family member of mine is considering signing a TD but he was declared bankrupt about 20 years ago and would like to know if a TD would be possible as he's got himself into a bit of bother again, thanks.

The former bankruptcy would not stop the signing of a trust deed or have any effect on it.

Hi whitley87,

There is nothing stopping your family member considering a Trust Deed or even declaring themselves Bankrupt.

It's more common than people think where someone gets into trouble again and has to consider one of those options to help deal with financial difficulties.

I've got a case at the moment where my client has signed a Trust Deed with my firm a few years back and also recently entered another Trust Deed with another company.

As we say to everyone who needs to consider one of those options it's always best to sit down with and advisor, discuss everything in person and make sure they receive exactly how things will work in writing.
