Can anyone advise me on a few things pls

Hi,

I entered a trust deed in March 2008 along with my ex husband. We split in March 2010 and I moved into rented accomodation with my 2 children (handed the house back to the bank with the permission of my trustee). After moving into my new home in July 2010 I contacted KMPG and informed them of the change of circumstances, they said they would send out a form for new income and expenditure (2 phone calls later from me chasing it I received it) I completed it and sent it back, heard nothing called them and they said they hadn't received it, sent another which I completed and sent back. I have heard nothing since this time and have made no contributions since July 2010. I find it strange that they haven't chased me for my contribution. Having spoken to a lawyer I was advised my best option would be to declare myself bankrupt???

Also my boyfriend and I are talking about moving in together, I would be moving into his home where he has a mortgage. He is worried that my situation will have an impact on him or his address as he currently has an excellent credit rating and no debt at all, can anyone advise me on this please?

If I contact KMPG and speak to them and ask to start making contributions again does anyone know how this will work as I've obviously not made any payments in over a year and a half.

Many thanks in advance for any advice, I am really stressing about everything.

If there are no assets to be dealt with or other matters, then the Trustee has the option to petition for sequestration or to proceed with their discharge which would allow you to petition for sequestration.

There should be no issue with you moving in re credit file etc as the bankruptcy would be registered against you. If there is any issues with the address, i understand that you can send a letter of disassociation to have this cleared up.

What do you think I need to do with regards to this, call KMPG and ask what (if anything) has been done? Sorry for my silly little questions, I feel like I don't know what is happening or what to do about it.

I think you should call and then write recorded delivery, explaining your circumstances and ask what their intentions are.

To avoid any credit availability issues for your partner I'd suggest avoiding any joint financial arrangements (like a joint current account for example).
