Breakdown of marriage

Hi,

My husband and I both entered in to TD's a year ago. Unfortunately, our marriage has now broken down and we are starting to think about the practicalities.

We have a joint mortgage. Will the sale of the house be forced due to the TD even if one of us could maintain the mortgage repayments? We have 4 young children and would liked to have kept the house for their sake especially during the early days of our separation.

Is there a particular reason that you fear the home would be sold?

Is there any equity in your home?

Many thanks for your response.

I just assumed that the house would have to be sold if we separated because we both have trust deeds.

There is equity in the house - around £40,000.

There is no reason that the house would automatically have to be sold, Natalie, though if there was an agreement in place regarding equity then this would still stand. I suppose a bigger problem might be being able to afford the Trust Deed payments previously agreed as well as any extension to deal with equity?
