Hi,

I'm just wondering if anybody has been discharged by Begbies Traynor Glasgow office and how long it took as I am having real problems.

I made me final payment on 1st November 2011 - almost 6 months ago now - after having adhered to all criteria during the 36 months of my Trust Deed. I phoned Begbies Traynor in February and was advised they were just checking for any outstanding PPI on my account. I called back in early March and was advised that PPI was not an issue but there was a problem on all Trust Deeds around HMRC and VAT on cases and this was holding up the discharge of my account. I was tole it's just one of these things and they have no idea how long it will take to resolve the issue. I phoned again on 5th April for an update and was told the person looking after my case was off. I was put throught to another woman in the office who tole me the hold up was checking the PPI????? When I told her I had been advised this was no longer an issue but that it was VAT she said she didn't really know but would e-mail the person who deals with my case and ask him to phone me the next day - I have yet to receive his return phone call. I just find it wrong that they can't tell ema a date when this VAT issue will be resolved and are willing to just let it continue. I asked for advice on here before and was told I should be discharged but they remain in office until the VAT issue is complete but Begbies don't seem to want to do that. I have had to communication from Begbies, it has constantly been me phoning them which I don't really have time for when I work 9-5 Monday to Friday. I don't know where to go with this as I am keen to get my discharge letter and move on but Begbies are the slowest company I have ever dealt with. Any advice would help. Or is there a Begbies representative on this forum? I think I have been more than patient waiting almost 6 months but I am beginning to lose patience.

Hi Wee Julz.

Begbies Traynor, like any other firm, are free to post here when their firm is mentioned in a thread.

The situation with Vat has been an unexpected and thorny problem for trust deed firms, but I believe the majority are now sure of their position and are closing cases.

In terms of response to your enquiries, it's difficult to justify any firm failing to adequately respond to legitimate questions after accepting thousands of pounds in fees.

As you signed after April 2008 I don't see why you cannot be discharged whilst your trustee remains in office to await the VAT reclaim, wee julz. You have met your obligations so a form 5 could easily be sent discharging you.

I have had nothing but problems with this firm , ignoring you whilst taking thousands in fees seems to be common pratice. Plus , being told that three seperate persons are dealing with my case , phoning all of them in different offices and then being told its the origional person that I should be speaking to !!. Hold on in there , you rightly expect a minimum level of service for the fees you have paid.

I am in exactly the same situation as weejules with Begbies Traynor and I signed my trust deed in 2007 and still have not been discharged same story waiting on VAT return. I have been told i cant get the easy discharge(5) as i signed prior to 2010. I,t infuriating as they took a lot of PPI also.They just get angry when i phone but i,m seriously becoming unwell over this.

I'm sorry to hear that you're stuck in that position. Hopefully there is some consolation in having completed your responsibilities and not having to budget quite so tightly any longer? I do appreciate that it must seem very unfair.

I take it no one from Begbies has posted a reply .
Stay tuned for other information regarding this company and how you are treated by them and their representatives I think my next post on this subject will expose numerous failings backed up by[}:)] hard evidence and proof , now going into YEAR 7 of a deed with them .

Thank you for the warm welcome. Would the Financial Ombudsman be able to help us ??? I want to complain about a good few misrepresentations made by Begbies Traynor Company. Also television advertising misleading people into thinking after 3 years thats it when clearly it is not !!! Who can put our cases forward to Begbies ?????

The Financial Ombudsman probably isn't in a position to assist you. This blog explains why:

If you feel there is cause for complaint about the conduct of a trustee the process is generally to:

1 - Complain formally to the trustee.

2 - If unsatisfied with the response, to complain to the professional body of which they are a member.

We do know that insolvency practitioners are facing a difficult and unexpected problem in terms of this VAT issue. I also acknowledge again that it will seem very unfair to be stuck in limbo as a result of that.
