bankruptcy!

can anybody help i have been in a trust deed for over three years and havent contributed for over two years as i have a serious gambling addiction and have also aquired about 5000 worth of debt since signing trust deed i have told trustee about additional debt but he doesnt want to help me he says he wants me to pay something towards trust deed and offer new creditors token payments but i simply cannot afford i dont have much surplus left i have asked him to sequestrate me but he refuses to what can i do next.

Hi Colin

Im assuming you signed after April 2008. If so, your trustee has 2 options and needs to decide which one to take.

Either discharge himself and allow you to petition for sequestration or petition himself for your sequestration. He can justifiably remain in office indefinitely. I would write to ask his intentions otherwise you will report matters to his governing body for failure to progress matters.

Hi keira22.

If there is a prospect of you becoming bankrupt soon I'd suggest you take whatever steps you can to control your gambling.

The Accountant in Bankruptcy has recently published a number of reports about restrictions/orders that have been imposed where people have become bankrupt with recent gambling debts forming part of their debts.
