My husband and I are currently in a protected trust deed. My husband has just found out his employer has not been paying his tax and NI for 18 months which we have calculated to be approximately ?รบ7000. We have no equity in our home and cannot afford to pay this amount to the tax office, if and when they approach us for it. Does this mean we are likely to have to go bankrupt as we are just getting by at present with our current outgoings, there is really nothing else we can cut back on.

Hi rooked

I would have thought the onus was on the employer to pay the tax and not you. I see no reason why they should pursue you for the arrears.

Have the deductions been propertly shown on his payslips?

Unfortunately my husband has been very niave and too trusting. The buisness he worked for was starting up when he became employed by them, everything was very chaotic, even my husband was working around 70 hours a week and not getting a chance to look into that side of things properly, he eventually left as he wasn't getting paid on time..he's since found out his tax and NI have not been paid. He contiunally asked for payslips or a p60 and more recently a p45...looks like he may have been working for a crook...one big lesson learned!

Hello rooked,

Has your husband got anything at all in writing that deductions were being made for tax and NI?

Does he have any colleagues who will have witnessed him being informed by the employer that tax and NI was being deducted from his pay?

He has no proof whatsoever, the majority of employees are very unsettled and want to leave because of this situation but there aren't many jobs out there, my husband was lucky and managed to get another job. He did claim jobseekers allowance for 3 weeks and told the job centre exactly what he was earning previously and that he was concerned his tax and NI had not been paid...we're just waiting for the chap at the door or a brown envelope coming through the door from the tax office for ?รบ7000...scary!

If he was an employee and not self employed, then i fail to see how he can be pursued personally.
