Bank Charges

Back in November I applied to my bank to get all my bank charges back for the last 10 years. Although a recent court ruling had sided with the banks, I was advised to pursue under the terms of "Financial Hardship". To my amazement I received a letter from my bank stating my case had been looked on favourably and they were going to award me ?ú3000. In effect every charge made to me over the last 10 years. So I guess I have a few queries:

(1) My overdraft of ?ú1500 was included in my trust dead. Is this debt still mine or will the payment from the bank pay this off.
(2) Should the full payment go to my trustee and not the bank as they now own the debt.
(3) Can I keep any of it.
(4) What the best way of letting everyone on this forum know they can get all bank charges back through "Financial Hardship"

That's a very interesting story albastef; thank you for sharing it.

Out of curiosity which bank have agreed to the payment? We have heard from a lot of people where their banks could not have been more obstructive no matter how much hardship the charges had caused.

Your bank may not actually pay the money over. It could be used to offset debts that are owed to them.

Should any payment be made to you I'm afraid that it's very likely that your Trustee would require it all to be paid in the Trust Deed to help offset other debts.

By putting this information in the forum I'm sure a lot of people will read it. It would be great if other people could share their experiences of having tried to reclaim these types of charges...

Would you let us know whether you do get to keep any of these funds, albastef? It is interesting to know how IPs are tackling these things - it may be that you will be allowed to keep some of it given the effort you have put in to "earn" the money.
I think if anyone else is thinking of trying to claim back charges, it might be worthwhile speaking to your trustee first and trying to make an deal so that it is worth your while fighting the claim.

Just been advised by my Trustee that I have to give all the cash to them, every penny! In response to TDAs question; It was through the Royal Bank of Scotland, who may I add have been very helpful since I signed up to my Trust Deed.

So I guess my advise to others on the Forum is; don`t bother it aint worth the time and effort!!
