Hi guys thanks again for your quick response like always !! i was not quite sure if this would have been a option i thought if you never had the equity then they would revalue the house then if it went up then so did your equity and if you could not find it then it would be sold is this not how it works . As at the start this was not discussed if i could not pay the equity on the house thanks

I would certainly query the equity figure and try to get it reduced a bit,anything less will reduce the length of time you have to carry on repaying. It really should have been clear at the start that if you couldnt release equity you may be expected to carry on paying for a lot longer than the 36 months.
