back dated benefit payment

hi i was receiving carers allowance because my son is disabled ithas been stopped and i have had to reapply if it is back dated do i have to pay that sum in tomy trust deed,also he gets direct payments for care the council made a mistake and had it down as an adult and told me i had to contribute to his care,after two years of this it has come to light i should never of been contributing they said i may get money paid back which would roughly be 1000 to 600 pound would this have to be paid in to trust deed as this was paid out by me before i entered in to trust deed, i just don't want to do the wrong thing by not paying it in to trust deed if have to thankyou pepper350

Hi pepper350.

I think the starting point is to inform your trust deed company about any extra payments you receive, whether they're regular or a lump sum.

As a budget has already been set up to cover your necessary living costs I suspect any additional sums you receive will need to be paid into the trust deed.

Hopefully the additional costs of caring for your disabled son were factored into your trust deed payment from the start?

hi TDA thanks for replying i will phone and find out if i do get back dated money what is to happen as i don't want to do the wrong thing,the carers allowance i was getting was calculated in with earnings as it has stopped i am now going to loose about ?รบ200.00 a month from that my sons own dla and his mobility was not included as it is for him and was advised not to include it in earnings

I guess your trustee may say that if the council had calculated the care payments correctly to start with then you would have had more disposable income to pay into your trust deed, so it is reasonable for them to request that to be paid in towards your debts.

In terms of the carers allowance, any lump sum isn't actually extra money is it? It is just covering a period in which you weren't receiving the payments. So whether you have to pay that in or not really depends on whether they reduce your payments during the period that you are not receiving it.
