Only a couple of days to go before I hopefully become protected.
Some last few questions on my mind....
I'm assuming if any banks had objections, they would have raised them long ago, and not left it until the last few days?
Anybody any experience with this?
If there had been any objections, would my TDC have informed me about it, or do they leave it until they have all the results in (as it were!!)
My 5 weeks are up on Friday, if my TDC has not been in touch, am I right in assuming I'm in the clear from close of business on Friday?
Is it standard practice for TDC's to phone up and let you know as soon you are 'protected'.
Thanks again!
Hello amorphous,
I'm not sure that there is s standard answer to your questions. Different companies will handle this in different ways. As such I'd suggest you give your trust deed company a quick call to ask about the response received from your creditors so far.
Fingers crossed for you.
Hi Amorphous,
I only had one objection a couple of days before it became protected, it was a very small (?ú1500) from Capital One but my trustee said this was not a problem. I would think you would have heard by now if there were any.
I phoned my Trustee on the Friday it was due to be protected at 4.55PM and she said it was all clear and could she now go to catch her bus home! Charming but everything was fine and I am sure you will be fine too, hope this helps.

Hi Amorphous
I`m in the same position as yourself as I`m hoping to become `protected` this Friday as well. Think I`ll try Perston`s line and phone my Trustee at 4.55pm !! Good luck
S
thanks guys.
I have emailed my TDC to see if they have received any objections!
There was a meeting on Monday with my creditors, so I'm sure if there were any probs they'd have been in contact by now!
Let's hope so amorphous - though unfortunately it does seem that quite often creditors do leave it until the last minute before they respond to proposals.
In terms of timings, trust deed assistant is probably right about different trustees having their own way of doing things. However, there is official guidance from the Accountant in Bankruptcy in this regard, as follows:
"The date of publication of the Edinburgh Gazette notice is the first day of the ÔÇ£relevant periodÔÇØ for creditor responses. The relevant period is 5 weeks and if, for example, it begins on a Tuesday, it will expire at midnight on the fifth Monday following. Any creditor who does not respond within this period is treated as having acceded to the trust deed."
So if your Gazette advert was placed on Friday 10th September then any objections from creditors would have to be received by midnight on Thursday 14th October (tonight!), otherwise the creditor is too late and is deemed to have accepted the proposals.
I phoned my TDC today, and found out that there was no record of any objections to my trust deed!
So it looks like I'm protected!!!! (although I won't actually believe it until I have the confirmation papers!)
I'm so relieved...its like getting my school exam results, passing my driving test and asking my girlfriend out for the first time all rolled into one!!
Thanks guys for all your help and reassurances on the forum...its greatly appreciated.
I still have two weeks before my trust deed becomes protected. Do you actually get confirmation in writing from the person at the company you have been dealing with? I'm on tender hooks such a nail biting time. Who would of thought that 5 weeks would feel like such a loooong time :). Like amorphous i'm very greatful for the forum as its much faster than contacting the particular person dealing with the deed and you get a variety of differant folks responses and experiences. Glad i found this at the very beginning.
Amorphous
As you know the 2 of us are on the same timescale.
I phoned my TDC today and was assured that everything would be fine and to call back on Monday. As you say though, until its actually confirmed then there`s that little gremlin in your head saying " Oh do you thinkso". I was told that the time limit was midnight tonight ( Friday ) as opposed to Kevin stating it was midnight Thursday. Nevermind, hopefully my new life starts on Monday. Dont think I have ever wanted a Monday to come around so quick.
Sherbo - I'm sure we will both be very relieved people at about 10am on Monday morning!
My TDC is under the impression that the deadline was Friday night too, but told me not to worry as it was extremely unlikely any of my creditors would wait until the last few hours to make an objection.
I'm of the opinion that Kevin is more probably right than my TDC though....I certainly hope so.
Amerififier - I think the next step in the process after the 5 weeks is up, is to send the finalised, confirmed version of the protected trust deed to all the creditors, and the TDC sends you a copy of this.
I'm told that will take about 5 days or so.
