Today I received letter from one of my former creditors telling me they owe me ยฃ700 following overpayment asking me to get in touch to get it back. I have been released from my t.d months ago so I guess the question is am I entitled to take this money or does it technically belong to somebody else ?

Hi dsx701

It could be complicated! Is the overpayment from a dividend paid to the Trustee? If so it should go to the trustee to be dispersed amongst your creditors.

If your trustee has been discharged then they have no authority to interact with the funds and these, I guess, would be yours.

Its basically from a credit card I had years ago saying they have reviewed the account and there has been some kind off overpayment I have called them and claimed it back I guess if the trustee has an issue ill soon be hearing from them in the meantime it will be nice to have sitting in my savings account

Hi dsx701.

Have you been formally discharged from the trust deed?

Was this card included in your trust deed?

I'm wondering if they might have sold the debt and then received a dividend.
