Advice please

I have 9 creditors with varying degrees of debt. 3 of them are on a reduced payment plan. One of the reduced credit card companies have frozen my payments for 12 months. But the loan with my bank for 16000 and o/draft for over 2000 agreed to reduce their payments for 6 months, after the six months is up I asked them if it is true that they will sell my debt to a recovery debt collection and they said yes that would be the outcome. My total debts are over 33000, my other creditors are receiving their minimum payments. Do I have any options open to me to stop them selling the debt on or not. Am dealing with the creditors myself. Any advice is much appreciated. Thank you.

Hi Zandra and welcome to the forum.

I'm not sure there is much you can do to stop your debts being sold on.

Having debts in excess of ยฃ33,000 would suggest that you need to speak with an Expert about your circumstances to see what options you have available to help you deal with the debts. Paying the minimum payments will unfortunately never really bring the level of debts down within a reasonable timescale.

Plans that you could consider could be a Debt Arrangement Scheme, Trust Deed or Sequestration.

Can you tell us a little more information about your circumstances such as do you own your property, have a car or any others assets? Also, how much do all of your minimum payments per month add up to?

The positive thing is that you have solutions to help you deal with your debts and we will be able to help you.

Thank you for replying David. Have no assets, my car is properly worth 200 as scrap. My partner is very financially stable and owns the home I share with him outright, I live in, but he wants nothing to do with my situation as he tried to help me in the past. My original loan with the bank was 16000, now approx. 14000 but with arrears approx. 210 a month down for 4 months. A loan with Advant for 4600 196 a month, now paying 96.40 reduced payments. M&S,have frozen payments. Barclaycard I owe 6240 at 146 a month. Credit Union 77 a month. Capital credit just under 1500, maxed. Aqua credit card 1900. Payday loans quite a few. Mob. Phones 45, ov/draft over 2k. Did take advice late last yr. from step change but due to my job and have gambling issues cannot peruse a trust deed. Have self harmed, and am not enjoying life. But I must stress, I do want to pay my debts. However I have not included personal debts to family, immbc. partner which amount to 19000.

Thank you for sharing this information.

What is it about your job that prevents you from considering a Trust Deed?

I see a lot of clients who have gambling issues and this doesn't prevent them from entering into a Trust Deed.

The main thing you want to do is speak with an Expert to go through a very thorough income and expenditure as this will determine what your available options are. Kevin or I would be more than happy to discuss this with you and give you an idea of the options. I'm sure within the space of 15-20 minutes of speaking with you we will be able to tell you the options.

As I've said you have solutions to help you deal with your debts and you will receive plenty of support, advice and help on the forum.

Also, well done for taking the difficult step to ask for help and advice. Often we hear from client and they say this is the hardest step to take.

Many thanks David, I asked a colleague for help last year and was informed that my employers' would have to know if I entered a Trust deed and could not not remain in my present role, Step change said it would e me 8yrs. and 9 months at that point in time and I didn't have the Advant debt then.

It's very unusual these days for a Trust Deed to cause a problem with someone's job. Have you checked your contract? What line of work are you in if you don't mind me asking?

It sounds like you have had a lot on your plate, but you are doing the right thing seeking help. I reckon there is a very good chance that your financial issues can be sorted out with some expert help, which would hopefully help ease the pressure on you and help you feel better generally.

As this is a public forum, am reluctant to divulge where I work, David. I was shocked that my colleague sought advice about me from a mgr. without my knowledge, although I think I remained nameless but as my nerves were shattered and am sure it wouldn't have taken much for them to know it was me. As for a sequestration I could never make good on my personal family debts. I had wished my bank would have given more leeway in order to snowball smaller debts more quickly, then tackle or be in a better position to make good. sough

The essential thing to bear in mind is that whatever route you choose to pursue must be realistic - both in terms of what you have to pay out each month and in terms of how long it will take to complete.
