Hi,
I got a trust deed about 7 years ago but never completed the payments as I moved country and no longer had a bank account in the UK and was really struggling with money. Unfortunately I was young and decided to avoid the situation rather than deal with it
I now am in a better situation, still outside of the UK, and I want to sort this out this mess I have made. Will I be in a lot of trouble?
Thanks for any advice.
Hi Lynne,
Welcome to the forum. I'd just like to say that I think it's great that you want to face up to this situation and put it right.
I doubt that you are in a lot of trouble.
It may be best to contact the firm who handled the Trust Deed to ask what action was taken following your ceasing to make payments.
Another option you could consider is to visit (online) a website called the "Edinburgh Gazette" and do a search in the archive using your full name. This website contains notices connected to Trust Deeds, failure of Trust Deeds, sequestration (bankruptcy) etc. In this way you may be able to find out what happened after your payments ended.
If you decide to do either please feel free to let us know the outcome. One of the experts may then be able to give you some guidance on the implications of what has happened for you and how you can go about putting it right if necessary.
Thanks for the advice. I checked the Edinburgh Gazette and there is only the original notice for the trust deed.
I have emailed the firm that handled this previously so will now wait for the response but unsure what to expect.
I'd have thought you would probably have been sequestrated in your absence, Lynne. I wouldn't worry too much about possible repercussions - chances are the whole thing will be done and dusted by now. I suppose if the debts were huge and you had assets that weren't paid over then it could be viewed as fraud and the answer might be different...
