Apologies, a bit late to the party with this post:-

If it helps at all here is what happened to me - early 2017 I received a letter from my former Trustee who said they had received a cheque f(not a huge sum, around £350) from a bank re PPI and (despite me being discharged a few years ago) cited the case of Mond and the potential to reopen my Trust Deed. Due to the anticipated timescale for that case to be resolved they offered to send me the cheque, allowing me to cash it but with a caveat that they could come back to me in the future to get the money back!

To top it all they decided to levy a £125 "administration fee" thus reducing the amount to be returned! I was annoyed at the time by a) the excessive charge as a % of the amount to be returned and b) the fact that I was discharged and they had (as far as I could see) no legal right to deduct any fee as such fees had not been agreed with me.

I decided to ignore the letter - fast forward to Autumn 2018 (!) and the bank informed me that the cheque had been returned to them. I also received a letter from the Trustee saying they had returned the cheque to the bank and had no further interest in reopening my TD.

By ignoring the letter and not paying the Trustee's unreasonable and non agreed "fee" I got the full amount from the bank.

Hi The Principal,

Sounds like a good outcome for you. The administration fee surprised me. It would have been easy enough just to return this to the bank and for them to forward to you.

Glad you got the full money in the end.
