Hi,
I'm looking for some advice. I signed a trust deed back in February but haven't heard any word from the company I am dealing with. I am still receiving letters and phone calls from banks and asking for default fees and even mentioning court action. I have sent statements etc in but still getting letters and calls. I have just phoned them to ask about this but was told I will still get letters and calls. I am still not protected which was a surprise after 18 weeks. Is this normal ??? Thanks
Hi Gary
You should have received a copy of the circular sent to creditors with the proposal. Hearing nothing after 4 months is certainly strange.
The Trustee is under certain timelines to send documents etc and 4 months is certainly not acceptable. Do you know if the notice in the Register of Insolvencies was sent?

Sorry I meant to say, you can check the Register of Insolvencies via the AIB website and check if the notice has been placed.
The Trustee has 4 weeks after the expiry of the 5 week period to submit the documents for protection, otherwise they need to start again.

Hi Mark, thanks for the reply. Sorry I have signed the trust deed and have had the proposal that is sent to the creditors. I have check my credit reports and can see the trust deed is on it. I was just worried that it's still not protected and I'm still receiving letters and calls. Is this still normal after 4 months.
Hi Gary
Its unusual that its not been protected by now. You should certainly chase this up with the trustee and ask why and get confirmation that creditors have agreed.
I would have thought calls would have massively reduced by now, but any you get should be referred to your trustee to chase up and make sure they have updated their records. It may be that they are waiting for protection to be confirmed.
