10% allowed to keep for PPI claim

Morning all

I have received a letter from a Solicitor acting for my IP who have asked for information to ascertain if I can claim for missold PPI. They will pursue the claim and do all the work as far as I can gather from the letter and I can keep 10% of any monies awarded. letter stating in a nice way if you don't co-operate IP will be notified etc.

Now you may think that I am greedy as my wife has a seperate trust deed so I was thinking would she also be entitled to 10%. I have contacted my IP to advise that my wife has not received anything from this solicitor however she would need to co-operate as the secured loan we had was in joint names. Not sure if they have sent to only so many of the trust deeds, would have thought they would have sent to all? Anyway IP said would contact solicitor to send same letter out to my wife. Did ask would my wife also receive 10% or would it be 10% between us - still waiting for an answer.

Do you feel that the PPI was mis-sold to you?

The matter of whether your wife might be eligible for 10% also is really between the two of you and your Trustee. You may wish to call him/her to discuss and I hope you get the answer you'd both like to hear.

Out of curiousity what is the percentage of the claim that the claims company/solicitor propose to keep as a fee if they win the claim?

I'd also be really curious to know what (if any) percentage of that fee the claims company will pay to your Trustee for the referral of your case to them.

As there appears only to be one Trust Deed firm doing this right now it would be very interesting for everyone I think if we could understand exactly how the proceeds of such a claim would be split eventually between:
You.
Your creditors.
The solicitor.
The Trustee.

We do feel we were pressurised into taking the insurance and did not realise that the insurance policy amount was added to the total cost of the loan.

What you say is very interesting. I was not allowed to have a firm that I chose to act on my behalf as this firm would not have been allowed to keep their fees which were made clear from day one. I thought I could use them and then if any monies were reecieved to pass this on to my trustee. Firm checked and their legal dept said they couldn't act for us and obviously trustee said no as well.

A you say there are 4 parties involved and its really hard to have someone dealing with your personal stuff when you have always been in control before. Would I be allowed to ask what all their cuts are before it gets to me and my wife? Thats if there is any claim to be made of course. Not that I am saying I don't trust my IP its just that they need to know all our personal details and changes to income etc yet I feel this is one sided. I am glad we signed the trust deed as things were getting really bad but think maybe should have shopped around for an IP but found this web site later. Was pressurised from Mackenzie Stewart to sign there and then and had no choice of who the IP was.

There's no harm in asking, liam. The whole thing should be transparent for everyone involved so I can't see any reason why they should not give you an answer that you will hopefully share with us.

I think that lawyers and claims companies have to disclose such referral payments, though possibly only if asked.

I do think that it would be fascinating to understand how the money is divided amongst the parties involved and do hope that liam will be able to find out for us.
