Hi,
I am, hopefully, only 3 payments away from finishing my trust deed and I am currently going through the final review.
Has anyone had experience of Wilson Andrews as a insolvency practitioner? If so, how long did it take you to receive the 'Form 5' discharge letter? Upon reading posts on here it seems that most people are waiting 5-6 months for this form, in which time although you have no payments are still liable to hand over any assets and are under their financial 'control'.
I am a little apprehensive as what I thought was a 3 year trust deed can now become a 3 and a half year ordeal.
Many thanks
Hi stubo79.
Obviously I cannot answer your question about your particular trustee. Perhaps someone else will share their experience. However, I'd still suggest contacting your trustee and simply asking them what their expectation of the time taken to discharge you might be.
I'm not sure that I agree with the five to six month average you mention or whether that's a useful guide. We hear about plenty of people discharged in a few weeks, and some horror stories of it taking much longer.
It all really comes down to how much of a priority this is for your trustee, and how busy they happen to be at the time.
Hi,
Thanks for quick reply. If it was only a few weeks to be discharged then what would be fantastic. I will call them to ask the question though.
So is it safe to say then that once you receive the form 5 you can spend your money as you see fit with no comeback from the trustee?
thanks.
Hi stubo79.
In terms of your own personal precise position, I'd double check anything that you're specifically concerned about with your trustee.
However, in terms of newly acquired assets after discharge for example, I cannot see how issues could arise.
The issues we've been reading about here more recently have been assets (typically PPI claims) that existed during a trust deed paying out to someone later. This may be a different matter.
Ok, many thanks for your advice.
I have also posted on another topic that I am concerned about.
Maybe you could help with that? [;)]
kind regards
Hi Stubo79,
A quick call to your Trustee should clarify their discharge process and timescale for this. I would say that if everything has been completed and paid then 4-6 weeks I think is a reasonable time for the discharge.
Until you receive your Form 5 discharge then if you inherit or acquire any assets these can be ingathered into your Trust Deed.
Let us know how you get on if you speak with your Trustee about their discharge process of timescale.

Dear stubo79,
My name is Steve and I'm part of the team at Wilson Andrews. First of all congratulations on almost completing your Trust Deed.
Once we've received your final payment we'll aim to have the Form 5 issued to you within a month. If you do need to receive this sooner then please give us a call, after your final payment has been made, and we'll always do what we can to speed things up for you.
Thank you
