Ok so We had a trust deed in 2011 and was cleared in 2014 great form 5 and fully discharged.
BUT.
My wife became ill last year and sadly passed away in December 2016, then I get letters from a old creditor looking for money.
as we were discharged can they still chase the money owed from 2011?
Thanks
I am so very sorry for your loss.
In short, no they can't. Your Form 5 is the end of your obligations to your creditors. Send them a copy of it for their records and hopefully you won't hear anything further.
Hi Luckysnoop.
I'd like to add my condolences.
Neverendingstory is correct. If you no longer have a copy of the Form 5 your former trustee or the Accountant in Bankruptcy may be able to assist you by providing documentary evidence of your wife's discharge.
Please be assured there's nothing this creditor can do to compel the repayment of this debt (assuming that it existed at the time the trust deeds began) whether you've proven the discharge to them or not.
Sorry for your sad loss.
No they can't chase you for anything. As stated send them a copy of your form 5 (if you have it) or simply 'phone them, explain the situation and if this persists get in touch with the ombudsman.
thanks, I still have all my paperwork form 5 etc, but just waiting on their bereavement team to get back in touch.
I just wanted confirmation on this.
Hi Luckysnoop,
Sorry to hear your awful news and for your sad loss.
As others have already confirmed there isnโt anything creditors can do. Confirm the discharge to them and that should be the end of the correspondence.
