Even if you "win", it looks unlikely that any financial return would flow your way.

Just one last question will she get into trouble from her trustee for not mentioning these debts and if i was successful in proving she owed them would she have to pay longer to her trustdeed or increase payments? i know thsats two questions. sorry.

Probably not as she contends that the debts do not exist. Is it a case of your word against hers or do you have any further proof that these were loans rather than cash passing between partners?
Payments into a trust deed are based upon affordability so the monthly payment would not normally change for this type of reason.
I think it's pretty unlikely that the term would be extended either.
You'd only find out for sure however if you followed this course of action and were effective in making your case.
