It's a welcome return for me almost four years after being discharged by my practitioner just a few months after my td ended. A lot has happened in the intervening time. I actually feel guilty at admitting that I took out credit in May of this year. However it soon passes as this is the only debt I have now and was for a car loan so was unavoidable. What elation I felt when I was passed with no problem at all ! To be honest I would have been surprised if I wasn't as my td would have fallped off my credit history a couple of months earlier and some three years after being discharged, but even so, this was the first "test" when the car company ran their checks, but as I say, it all went through swimmingly !
To all those on here, I hope you are all well. It's a pleasure to be back. I long remember the dark days when I was on here all the time but equally, I also remember the wonderful people whether it be the advisors or the posters who were of great help to me during this awful time. No question that was asked of them by myself was ever considered too insignificant, stupid or trivial and all were answered in a professional and helpful manner. I said at the time and will say it again, for those that are perhaps just setting out on their road to recovery, this site is so therapeutic and you will undoubtedly get much comfort and solace from it by realising there are people on here in exactly the same boat as yourself and that there is absolutely nothing to be ashamed of in being in this position. No one is on here to judge, just to help.
Come February, four years will have passed since I was finally free of everything but that doesn't mean I don't still have a question !
As I'm sure many of you will be aware, new PPI guidelines have come into force. Previously when a search was done and nothing found the case was closed and that was that. However, it is now possible that these cases can be reopened and a further search carried out and now there are some cases where PPI is found and subsequently paid out where none was found in the initial search.
Unfortunately, certainly in my case, this has now lead to an explosion in cold calling. However, as I was now "free" so to speak, I did give out details to a company for further checks to be done.
So my point is this. I had about fiver creditors all caught up in my td and obviously all received a small percentage from the pot. Obviously the search for PPI was the last thing to be done before I was discharged once and for all, and when that was completed all were satisfied, and everyone went home happy, not least of all me !
But now I find that this new second check on one of the creditors credit cards I had, has discovered PPI of a few hundred pounds. I received notification a few days ago and was told to expect payment within 28 working days. Far from being excited by this development, given previous circumstances, my first reaction was to be wary and perhaps to expect this company to be totally aware of my history with them and notify me that they will claw this money back.
However, I have just discovered that despite saying last week about paying me within 28 days,they have actually paid it directly into my bank account today.
So I am a bit confused. I know that creditors can still have a claim after you have been discharged but before your practitioner has, but how does this work when PPI has been discovered on these new second searches on a claim that formed part of the td from six years ago ? After all, this is only happening now because obviously new information has come to light that wasn't available back then.
Do they have a claim or am I in the clear ? It's not exactly lifechanging money, only a few hundred quid but an unexpected windfall nevertheless, but trust me, I won't be spending any of it until one of you guys on here give me advice on it !
A million apologies for rambling on and on, but it's so good to come back on here ! I must do it more often even if it's just to add my words of wisdom to anyone on here that may need them. in much the same way everybody helped me in my hours of need.

I'm in the same boat as you - got a payout, but too worried to spend it!!
Contact your ex trustee, see if they can clarify things any.
FWIW, my trustee said that they are not interested in the money 'at this present time', which is too ambiguous for my liking ๐

As amorphous highlights there is another recent thread which covers this subject.
The problem with providing answers you can rely upon on this subject as that those answers don't necessarily exist. The subject remains to some extent legally contentious and legally unsettled.
That's why a former trustee might use the "at this present time" qualification that amorphous mentions. Nobody is quite sure where this is going.
