Hi
I was discharged from my trust deed in February 2017, my husband was discharged in January 2017. We both received our form 5. However now waiting on my
Form 6 for my trustee discharge. My husband received his back in June, but on contacting Knightsbridge about mine they have said they are waiting on one creditor , Capital One, for the required information they need in order to pay them their dividend, as they are not legally allowed to keep funds that belong to a creditor until they have sent the relevant information.
Is there a timescale for capital one to reply to them?
Hi lp24,
The Trustee should eventually set a cut-off point and notify the lender that if they fail to submit a claim within 14 days then a final 7 days they will be excluded from receiving a dividend.
From our perspective when dealing with a main creditor like Capital One we never had a problem obtaining a claim from them. Sometimes if a claim is outstanding we will give them a call to chase this up and will have it back within a couple of days at the latest.
I would give your Trustee a call and ask them to chase this up. I canโt see it being a problem for them to do this.
