This question has probably been asked a thousand times but here it goes again. Scottish Power have sent me a bill for the electricity in the communal area of our building which has been back dated from oct 2008 and is to be split between the 6 flats. Firstly, can this be included in my TD? (I don't think it can but thought ask anyway) and secondly does anybody know how far Scottish power can legally back date this bill.

Thanks

SkintAlly

Hi SkintAlly.

Could you just remind us when you signed your trust deed?

Who splits the bill? Do you pay Scottish Power your share directly or do you pay another party?

I'm not sure that there's any legal issue with them backdating the bill a couple of years but I'm sure someone will correct me if I'm wrong.

Hi TDA

I'm still going through the five weeks just now. Notice was published on 22nd July. As far as I can see they are looking for one of the residents to pay the full charge and then seek payment from the remaining. I don;t think there is an issue with paying direct if we wish to

Do you have a factor and if yes who is your factor.......?

Usually it would be up to the factor to pay the "Landlord/Communal Supply" then they should in turn bill the owners for for their share....

Hi SkintAlly.

I was thinking down the same lines that Porcupine has asked about.

Also, do you own your flat?

The answers may make a difference to the scenario.

Hi Guys,

I do own the house. There isn't a fixed factor for the flats, we normally all get together when issues arise and pay our share as and when required.

I don't know what the "technical" answer is here SkintAlly (about whether or not the debt should be included in the trust deed).

On a practical level, it does sound as though if you don't pay your share Scottish Power might expect your neighbours to do so for you?
