Trustee discharge

Hi i was discarged on 1/11/2018 i contacted my trustee this morning trgarding thier discharge .They said still waiting to distribute remaining funds to creditors seem the are waiting on evidence and a claim from one .Do the get a set period of time to make a claim or can it drag on and on forever. And what happens if they dont mske a claim .

Hi Marieh38.

The trustee is likely to take some time to try to ensure that the funds end up where they should do. It's not a fixed period.

If a creditor doesn't submit a claim within the period a trustee allows, the other creditors that did claim are likely to receive more.

I thought that it would be distributed to other creditors .When you first sign your trust deed does the trustee not contact your creditors at that point to tell them the debt has been included in a trust deed proposal and to see if they object .If so then should they not have correspondence regarding the debt they have asked if i have any paper work or refrence number in regards to it but i dont have anything.

Hi Marieh.

You’re right that known creditors are contacted at the start.

The difference at the end is that they need to provide proof of the debt in order to receive a dividend.

So how long will the have to produce proof before they get excluded from the trust deed its been almost 5 months since last payment and nearly 3 months since my discharge .

That's up to your former trustee Marieh38.

You might want to ask them about the timescales they use.

I was discharged in July. I got letter last week - trustee just been discharged!
