Hey there,

looking for some advice, my final Objection date was Monday, I called up today to check how things are moving and they tell me that the date has been moved to the 19th of October, this is because they had to re advertise the proposal on the 17th and 3 days would not give the creditors a fair amount of time to reject. I am a little confused but they have already taken the 1st payment , is this normal?

Hi Michinnom and welcome.

It is common for payments to begin once a trust deed has been signed.

Is there a particular reason why it was re-advertised?

Hi,

If there has been an error in the proposal, sometimes this can be the address being wrong on the advert on the ROI then the case needs to be re-advertised.

Iโ€™d ask your Trustee what the reason was for the case to be re-advertised. From being re-advertised the creditors need another 5 week period.

Itโ€™s correct that the payment will have already started before the TD has been accepted by the creditors and protected.

Sometimes cases have to re-advertised due to an administrative error. Unfortunately this starts the 5 week objection process again.

If the creditors accepted the first proposal , no reason why they would object to the second one.

Taking payments before protection date is normal.
