Surely the whole process is null and void if the proper procedures haven't been followed in this case?

Like me you have hit the nail on the head, but the law seems to state differently, the sheriff clerk stated on his letter after me explaining everything I have said above.
It would be inappropriate for My Lady to make comment, surely that sets alarm bells ringing that there maybe an instance of a miss ruling in the case or has he actually informed the sheriff I had written questioning the decision his sentence makes me wonder.
All the wonderful comments from you guys taking the time to reply and read the posts is overwhelming it's the first time since the 1st of December that anyone has taken any notice and to offer advice, because the 2 companies in question just say the law is the law and hit me with all these references to rules in the law way way above my head

I would be interested to here if you ever did get a chance to seek a (good) solicitor, I am starting procdings aginst a company for mis selling of a trust deed, like your self it seems there is not regulation going on and some companies operate how they see fit, theses companies think people wont fight back.
