I signed up with Kelsom for a trust deed of 36 monthly payments @ £315.
At some point during the term of my trust deed it was passed to Knightsbridge.
I have now paid all 36 months as per the signed agreement I have, however they are saying that the trust deed was amended at some point and changed to 42 months.
They have produced a document that states 42 months but it is not signed by anyone and is not the full proposal.
Does anyone else have any experience of anything like this or any helpful advice to offer? I have provided them with a copy of my documents and they have logged it as an official complaint whilst they investigate.
Hi Craig@38 and welcome to the forum.
I think you've done the right thing by querying this, evidencing your position, and getting them to investigate this from their end.
If an extension is appropriate, they shouldn't have any difficulty demonstrating to you why that's the case.
At the moment it may just be a case of waiting to hear what they come back with.
Hi Craig@38 and welcome,
Like TDA has advised I think you will need to wait for them to resolve your complaint and respond with their reasons why they have asked for an extension of 6 months.
An extension can take place for a couple of reasons. if there has been a change in circumstances whereby the individual has increased their income but not notified the Trustee about this. If a client could have therefore increased their payments but didn’t then an extension could happen to ingather these payments. If a client has inherited an asset or had a windfall etc that they have failed to notify the Trustee about. These are all funds that could have been ingathered into the Trust Deed.
The important thing is that any extension will need to be for a valid reason and the Trustee will need to justify this. They should therefore be able to clarify this for you.
Once you hear back from them regarding your complaint please let us know. If after you do hear back from your Trustee and you are not satisfied then you can consider a complaint to your Trustees authorising body.
