Don't worry too much - this is quite an old thread!
Nowadays (since July 2011), if you're in a trust deed which isn't protected you can apply for DAS.
Yeah notntodeed, it's a worrying time.
I signed my deed on the 29th of May and I just keep reading up on trust deeds, almost looking for a reason that it can go wrong.
Listening to all the experts it seems we're worrying, if not unnecessarily, then far too much for the risk involved.
That doesn't stop me worrying but I'm not averse to paying all my creditors back in full through a DAS no matter how long it takes so I feel a lot better knowing that's my fallback position rather than sequestration.
I just want it settled one way or the other and for the hassle from creditors to stop. I've already changed my ways and settled into my new "living well within my means" lifestyle but I'm getting umpteen phone calls a day and it's got to the stage I'm not even answering the phone now. I'm sick of telling the same creditor the same story only for a different person representing the same company to phone 10 or 15 minutes later.
Try not to worry too much, my ptd was accepted,whilst my wife's failed,and she was sequestrated,it worked the same way as the trust deed with monthly payments,but as the experts say this was done pre 2011,and also your expert will probable be pretty sure, that it will be accepted,give the information you supplied.
