Trust deed form 5

I wonder if anyone can advise please. My husband & i received our form 5 dated 6th December 2012. Trustee stated he would try to finalize things as quickly as possible as he had a few loose ends to tie up. We have had no further word saying he has discharged himself. Checked the ROI & there is nothing there stating that we have been discharged. Wondering if it should take trustee this length of time to wind things up. Any PPI was paid to trustee well over one year ago. Many thanks.

Hello topsyturvy.

If you've received your Form 5 you have been discharged. Your trustee remaining "in office" should make no difference to you.

Does the Register of Insolvencies confirm that the Form 5 has been issued?

No it does not confirm, there is nothing saying me or my husband have been issued with form 5.

I think you should check that situation out with your trustee topsyturvy.

It seems strange that you have a copy of the document but that it hasn't been registered. Perhaps it could be an admin error by your trustee or those that update the register?

Just managed to speak to someone in trustees office & they said this does not apply as trust deeds signed before April 2008 & they are presently in the process of discharging themselves. Thanks again.

Ah... that does make a difference. My apologies, I think we probably just assume that we're talking about trust deeds signed after April 2008 in the forum now.

I'm glad to hear that they've confirmed that it's all coming to an end.
