Trust deed appears to be extending??

Hello
Im currently just starting year 4 of my trust deed. Its supposed to be a 4 year trust deed so this should be my final year. Today I received a form 4 from my trustee for year 3 and noticed the sentence " I expect to obtain my discharge as Trustee by September 2024.

I was making zero contributions for my 2nd year and reduced contributions for my 3rd year. Does this mean they are extending my trust deed for a longer period. I was advised by them when I reduced my payment to zero it would not affect the length of the term.

Welcome to the trust deed forum ged55.

We cannot assume that your trust deed is being extended from this information.

Your trustee's discharge is a separate event to your own discharge. Yours will happen first.

I'd suggest contacting them to confirm that your own discharge is still expected to proceed upon the completion of the four year period.

Hi TDA

Thanks for your reply. I just saw that date on the form and panicked a bit. I was advised that it wouldn't extend my term length making zero and lower payments so fingers crossed I'll still be discharged after 4 years.
I shall contact my trustee to clarify.

If a trust deed was extended can a friend/partner pay the remaining contributions after month 48 to allow discharge on time?

Hi ged55,

This would normally be possible once the four year minimum legal term has been completed.

It's generally in the best interests of both the creditors and the client if this becomes possible.

Sorry but I have one more question. My trust deed is going to be extended by 4 extra months due to some missed payments. Would it be acceptable if a family member paid the surplus income total of that 4 months to the trustee now so that discharge could happen on time? Thanks

I can't really see why that would be a problem ged55.

However, this is a question to ask your trustee directly.
