Please could someone tell me if you have an accident claim does all the proceeds go directly to the trust deed?

It's a tough question. I remember a similar question being asked quite a while ago and the experts, I think, suggested that it depends upon what exactly the payout was for.

Accident claims payouts tend to be made up of parts that cover different aspects of the claim.

For example, if you had injuries from a claim that required you to pay for treatment in the future part of the payout would be to cover that cost. In that instance it seems likely you'd keep that part of the payout.

More general parts of any payout are likely to have to be handed over to help repay the creditors.
