Hi Hoping someone can help. We entered into a Trust Deed in FEB 2007. We fulfilled our payments by AUGUST 2011 and requested time after tiem our discharge papers. We never heard a thing so wrote to KPMG asking for them, finally got them by Recorded Delivery in OCTOBER 2012. OCTOBER 2013 we were awarded thousands of pounds in PPI , only to be told as we were still in LIVE trust deed, only our trustee could accept!! its not even about the money, its the principle of this. 7 YES 7 years later after entering trust deed we are still slaves to KPMG!! Cant move on, cant get better mortgage deal, cant start to rebulid credit history, nightmare, am now consirdering FCA! And to top it all we have received yet another letter from a creditor with same balance as we had with them in 2007! Can you tell me where the money is? Is it languishing in KPMG's bnak account gathering more interst for them? Shocking and I wish I had went BANKRUPT would have been easier and at least my wife would not be so ill! Illness is what started it in 2007 see a repeat of it all Thanks for nothing KPMG!!!!

Are you certain that you've been discharged?

The date that you signed means that your trustee could not discharge you until they'd finished their work, including collecting in PPI so that more of what you owed could be repaid to your creditors.

If you are sure you've been discharged, are you sure these PPI payments actually were paid to your trustee? Or were they simply not paid to you? Which banks were involved in the claims?

Assuming that you have been discharged, your trustee has no role to play regarding your credit rating. If there are problems still they're for you to resolve and develop a positive record again.

Ignore the creditor letter. If a bank has failed to update their records following your discharge you still don't owe them anything. You may need to address this with the bank though if they're still reporting to the credit reference agencies.

One other point, any interest accruing on funds being held for you, if you weren't discharged, would be for the benefit of your creditors rather than your trustee.

Hi TDA Thank you for prompt reply. We received DISCHARGE PAPERS by Recorded Delivery in Oct 2012. The bank has awarded us over 12k but will not pay out to us as we are in a ''LIVE'' trust deed. Only the trustee can accept it. We sent copy of discharge paper to bank but they will not dal with us. all other successful PPI claims have been paid to trustee AFTER OCT 2012

We had letters from debtors advising us how much they paid to Trustee. So we did not get paid. My question is should they not have have discharged us after final payment in August 2011? Why wait until Oct 2012?

Hi.

People can be more simply and therefore promptly discharged now. Sadly for you these rules changed after your trust deed was signed. It shouldn't make any difference to you now though, the trust deed should drop off your credit file six years after it started.

Were the PPI claims with RBS?

Have you spoken to KPMG about whether they've received payments and what's happened to them if they have?

It was RBS and reading other peoples complaints we now know we will never get a penny, however I will speak to them to ask what has happened to all the PPI they have been awarded.As well as RBS its runnig into thuosands of ££££. I am assuming these go back into the debtors pot?

If you've been discharged and debts have been written off RBS appear to have taken the view that they don't need to pay you.

That's nothing to do with your trustee who will not have got the money either I'd imagine.
