i have now been in a trust deed for just over a year. my husband and i have now seperated which leaves me with a huge mortgage which i cant afford. although this is joint he wont pay anything towards it unless he gets the house. i am prepared to give him the the house and and let him remorgage on his own and keep the house as. but im assuming i cant do this whilst in a trust deed!!!!! any advice would helpfully

Hello nells.

Is there any equity in the home do you think?

Have you already been made aware of any responsibilities for equity connected to your trust deed?

Hi

thank you for replying. i wouldnt imagine there would be any equity since i only signed the trust deed in 2010 and as the housing prices have never really risen i couldnt imagine this to be the case. i have also signed a document and agreed to extend my TD for a futher 2 month to cover a £500 payment to cover the equity on the property.

Hi nells.

I cannot really see why there would be an issue with this; there doesn't appear to be any detriment to your creditors.

It's one of those issues where I think you need to talk it through with your trust deed provider now. I'd imagine that under the circumstances they'd want to be supportive and helpful.
