I was wondering if anyone could help me or if anyone has been in this position. I know that you are unable to apply for PPI whilst in a trust deed as anything paid out will off set the debt that you currently have. However, I have just received a letter from Apex advising that I have now reached the 3rd anniversary and they are investigating whether or not I have been mis-sold PPI. Can they apply for this on my behalf?

The short answer to your question is "yes".
Your potential to make PPI claims was an asset that existed at the time when you signed your trust deed.
Signing your trust deed meant that such assets "vested" in your trustee. They're duty bound to investigate whether such assets can be used to repay more to your creditors.
PPI claims are an area that the regulators of insolvency practitioners expect them to investigate. You may be asked for some assistance with this process by your trustee.
