I had a TD from 1997-2000.I have recently made a claim for ppi with M&S.They want details of TD but I don't have them now.Is there any point in continuing my claim? I have had money back from ppi before

Welcome to the forum Lindar.

If you can remember the firm involved, they may be able to provide details to you.

Otherwise I'd suggest contacting the Accountant in Bankruptcy, which should have access to historic personal insolvency records including your case. There's a contact telephone number on their website.

TDA. Why does this company want the TD details after such a long time has passed since this trust deed? I thought when we conclude with the TD and enter into the 6th year from it becoming protected this allows us to return to the norm in regards to credit etc.

Hi Jimuc.

With some types of personal insolvency this PPI money would always be offered to the insolvency practitioner or trustee first. It’s much more contentious with trust deeds, but those paying out claims are covering themselves from having to pay out twice if the money incorrectly went to an individual and couldn’t be recovered. In reality, I suspect Lindar will get the money after the firm completes its processes.

The six year aspect of credit files is different to PPI because lenders can quite legitimately pick and choose who they want to lend to and upon what terms. Generally they’ll rely on the 6 year content of a credit file to help make this decision, but they’re also entitled to ask about prior insolvencies as part of the application process if they deem that to be an important factor. Most don’t.

I have contacted AIB and they no longer have any records for me,I have phoned M&S and they will look into it again
