Hi Gillainr2,

Totally agree with the statements made by Mark and Kevin in relation to this matter. On a separate matter and not through any expertise on the subject of Housing have you considered or discussed with the Local Housing Authority how you will be affected by voluntarily giving up a property. I would possibly check that your actions are not "making yourself voluntary homeless" are not considered as making yourself "intentionally homeless" which may have an effect on eligibility to LA housing.

Thanks Mark and Chris.

My husband has emailed the advisor that is acting on the behalf of the trustee and has asked her to clarify with the trustee that what was said teh last time was in fact incorrect. He just stated he had sought "independant advice" on the matter and had been advised that the imformation he had been given was wrong and he would like the trustee to respond to this. He also stated that it is his intention as previously advised to still go ahead and voluntarily surrender the house sooner rather than later. Hopefully she will come back to us at some point without the usual need to chase her 3 or 4 times first!

Thanks for that info Chris, we went in to see the hosuing officer at the end of Nov last year and he said it would be ok to voluntarily surrender the hosue as it wouldn't affect us unless we wanted to go on the homeless list which we don't (it could take us outwith this area for the kids school). We decided to stay on the normal list so it could take a little while to get housed through the council. My little one has recently been diagnosed with a disability and with the damp and things in this house we are now just desperate to get out of here asap hence looking at private rental. They dont come up very often in our area but a lovely house has came up for long term rental and luckily it seems we will qualify for housing benefit meaning the rent will still be alot less than the mortgage on this house and the rental is a lovely big house, much better than here. We have our fingers crossed that things will go ahead with this house as the owners are aware of our situation and are still happy to consider us as are the letting agent as long as we have a guarentor.

I must admit that I feel very nervous about the whole thing though, i've been awake at night worryign about how to voluntary surrender and what if Virgin Money want him to sign something that says he will pay the money back after the trust deed or wont accept voluntary surrender, what if they put notices on the windows (we live in a village), all the nosey parkers round here that will ask why we moved and why the house isn't for sale yet, what if we move and then something goes wrong with the lease or they change their minds ect ect ect... can you tell im a born worrier? I just knwo that it would be a fabulous move for our family though.

This must be a worrying time for you.

I think you're going to need to be quite tough to get the outcome that you're looking for. It seems that your family, the trust deed creditors (and your trustee), and Virgin Money, all have different and conflicting interests at the moment.

Yeah it's a very nerve racking time indeed.

Been to see the house this morning and it would be perfect. My parents have said tehy will be guarentors so just waiting to hear back from the letting agent to make sure that it's ok with the owners but she is sure it will be. The letting agent said they would still do all teh cheks on us even though they know we will fail the credit score as long as my parents pass the creidt score then it will be ok (they will pass it no prob). However, they also want the trustee to send them a letter confirming that we can afford the rent! That's a hurdle considering how rotten his trustee is. Husband is going to call the trustee today to prewarn them about it and tio talk them through everything such as althought the monthly rent is £695 so £195 more than our mortagge per month, we will eb entitled to £480 housing benefits so we would be paying £215 a month instead of £500 which would free up extra money towards the trust deed. We are hoping they will see this as a positive thing and will agree to send them a letter.
