hi can you advise me please. My trust deed was fully paid in Oct 2014. They did not discharge me until July 2015 as they said they were still looking into PPi claims. They still have not paid the creditors and its now 14 months later and Im still getting letters, and it remains open on my credit report. I presume its because they still have not sorted the PPI. Is there anything I can do about this? I have paid in full but they are taking too long investigating PPI, I now have this on my credit report for a further 14 months after being paid.
Just to be clear i did receive a letter of discharge in july 2015 and my credit report says I am discharged from the trust deed but all my creditors still have the status as open cases and in default. The TD people say they cannot pay them until they have finished with the PPI claim. So does this mean they will continue to send me letters saying I owe them money until the TD person pays them? When I complained to the TD people they said they do not know how long it is going to take and it will show on my credit report for 6 years AFTER I have been discharge. Is this correct?
Welcome to the forum phyl and congratulations on completing your trust deed.
The issue here is with your creditors, not your trustee.
Your trustee has met their obligation to discharge you after you have completed your obligations to your trust deed.
The fact that your creditors aren't yet paid is irrelevant in terms of what you can expect from them. Basically, you've been discharged and they've no right to seek to collect money from you or to report to the credit reference agencies that you owe them money,
Sadly, the onus is now upon you to contact these creditors and require them to update your credit file. Debts should be marked to show nothing is owed. Default notices should be marked satisfied or partially satisfied. This is information we've verified with the Information Commissioner's Office, responsible for data protection and accuracy in the UK.
Sadly it also seems you've been given incorrect information by your trustee about credit files. Anything that goes onto your credit file stays there for six years. For example, the fact that you were in a trust deed will not be evident on your credit file six years after it began (not ended).
Thank you TDA the information you have given me is very helpful xx
