Hi sorry to bother everyone again, I have recently spoke to the aib regester and they have informed me that after the trustee discharges itsself from thr trustdeed, it comes off the register 13 months after it was discharged, so if its off the aib register and off credit file, how do they no you have been in one if there is now no record of it, which brings me to ask do u need to delcare having been in one? Or is there another record or fway of finding this out? Sory for all the questions, thanks

Lenders are entitled to ask about this in their application process.
If you answer untruthfully you're at risk of being accused of mortgage fraud.
It's possible they retain their own information about personal insolvencies which, after all, are public information at some stage.

It’s always best to be honest when dealing with things like this. If the mortgage application asks about previous Trust Deed or Bankruptcy and you don’t truthfully answer then as TDA has advised you could risk being accused of mortgage fraud.
Also, just because you answer yes to having a previous Trust Deed doesn’t necessarily mean you would be refused. It could be the case that your mortgage application needs to be scrutinised more by someone for a decision that could still come back approved. If you didn’t answer truthfully and then they found out I suspect they would reject the application.
We hear from people on the forum who have successfully completed their Trust Deed’s and then went onto secure a mortgage and become a home owner. I’m sure if you do things correctly you will be the same.
