Hi folks. I'm new to this to please be gentle! I started my trust deed in April 2010 and it still rumbles slowly on with a projected discharge date of august 2015. This was due to my income being slightly more over the first 2 years of my trust deed. Never missed a payment so I was a little disappointed that it was extended by over 2 years. Has anyone had this happen to them?

As trust deed payments are based upon affordability there is a responsibility for clients to inform their trustee when something changes.

In terms of increases most commonly I suppose this might be a pay increase, but it could equally be a reduction in expenditure such as a reduction in a mortgage payment.

Where such a change takes place and it's discovered later, or only reported retrospectively, the creditors will have been entitled to receive more. The trustee is obligated to deal with that under the terms of the agreement made by their client and their creditors.

We do hear of this happening here from time to time. To avoid it (and I appreciate that this will not be helpful to you now) we advise people to tell their trustee of a change of circumstances as soon as possible after it happens.

Thanks for your prompt reply ๐Ÿ™‚ What you have said kind of fits with what i thought, just disappointing when you think you are nearly there and then the finishing line moves and it all seems so far away again. Cant complaint too much as Wilson Andrews have been brilliant throughout the whole process.
