SEQUESTRATION FOR CSA DEBT.....WHAT A JOKE.!!!!

This is an absolute disgrace...I have been divorced from my ex-husband for 8 years, and in that time he has done everything in his power to avoid paying maintanence. He has been non-compliant from day 1. The SECOND liabilty order was granted in court today, and his solicitor had the cheek to inform the sheriff he now plans to file for self sequestration. In the 8yrs (exactly 98months) since our separation, he has only made 17 payments....and only then because the 1st liabilty order was granted against him. He stopped making payments again as he claimed he 'couldnt afford it'. He repeatedly refused to provide income details to prove this. The most sickening thing about this is, while he was pleading poverty he could afford to have more children. HE COULDNT PROVIDE FOR HIS FIRST 4 CHILDREN....YET COULD HAVE 2 MORE.!!!! It now seems under scottish law, sequestration is the easy answer for dead-beat runaway dads. Crank up as much debt as you like...then sit back, pull the plug and watch it all disappear. While the parent with care has to work every hour god sends to put a meal on the table...!!! Where's the justice in that.??? Its a bloody joke, 1yr out the financial rat race is hardly any great hardship for irresponsable parents who just dont give a damn. CSA arrears should NEVER under any circumstances, be allowed to be included in sequestration...especially if it is being filed for precisely that reason. The Scottish Government should take a long hard look at the legislation if they think this is acceptable. If it's disallowed in english bankrupcy...then it should apply up here aswell. I intend to contact my local MP, the Secretery of State for Scotland....and bring it to the attention of every tabloid in the country. Dead-beat low-life parents should be made to pay for every child regardless of anything else, and i personally dont intent to leave the matter at rest.!!! So, the message is simple...if you cant provide for your children...STOP HAVING THEM..!!

Hi hollyhonda and welcome.

I can totally understand your frustration and anger.

The key here (for the future at least) seems to be finding a way to ensure that payments are made (and continued) right from the start.

Once debts have built up, whether they can be written off by sequestration or not, there is almost nothing that can be done to make anybody pay money that they no longer have.
