I'm currently in the 5 week waiting period, waiting to see if my trust deed becomes protected. I was told that I wouldn't need to sell my car because it was only worth £4000 and I need a car to carry out my job. I guess it's a case of if I was forced to sell my car to raise money, then I wouldn't be able to carry out my job therefore I'd be unable to make my monthly contribution? The problem is that my car has developed a serious problem and requires a new engine (which would cost more than the car's worth) so I was forced to advertise it for sale. After it was advertised, I received my documentation from my Trustee which tells me that I must not sell the vehicle during the Trust Deed period. I called them to say that I had advertised it before I knew this and they said they'd need to 'look into it' and decide what to do. They still haven't come back to me and I've now had a buyer approach me who has purchased the vehicle. I didn't get the asking price of £4000 but I'm not sure what to do now. I need a car to carry out my business and I appreciate I may not be able to keep all of the money I made from the sale of the car but I find my Trustee slow and vague with information. Can they request all of the money? If this happens, how am I meant to buy another car?

Welcome to the trust deed forum stella284.

I think you can only liaise with the trust deed firm at this point. They will understand that you need a vehicle in order to work; this will be something that applies to many of their clients.

Hopefully they will be tolerant of the fact that you sold the car after being instructed not to so early in the trust deed.

You may wish to call them and put on record that you intend to buy a new car now with the proceeds of the sale. If they do not tell you otherwise you may feel a little more sure in your position.
