reopening of Trust Deed Hearing

Hi, All, My husband is at court tomorrow defending a re-appointment of a trustee. His trust deed was discharged March 2011. He has successfully won a PPI claim. The bank notified BDO of this and they accepted the cheque. After some phone calls, the bank has now cancelled the cheque to them and found in his favour. I will keep you updated with the news from court. Just to say to you all, Keep fighting.

Well folks the Sherriff put it back for a week to give BDO lawyer time. Seems they thought it was an open and shut case. I will keep you informed as to how this plays out. The bank have admitted they were wrong to contact the ex trustee. My husband informed them numerous times and he even sent in a written complaint. The bank contacted BDO and were given the run around, so they spoke to their legal team and they found in his favour. The money is en-route to my husband as we speak. Just need to wait and find out if he gets to keep it now. A new trustee has not been appointed yet.

I may be wrong here, but as the bank have now issued the funds to your husband after admitting an error, there are no funds for BDO to claim as theirs?

True, but they will try. I think they just want the money.

But the funds have been awarded to your husband as a PPI award by the bank. BDO have no interest in it.

BDO....the ppi award forms a contingent asset which you conveyed to me upon signing the trust deed. That is their words in a letter.

What I'm saying is that if the cheque was sent to your husband in the first place, there would be no funds for BDO to try and gather in to distribute to creditors.

Your husband will now have the funds.

Yes, but he has been advised not to spend any as this could go either way.
I myself received ยฃ6000 from ppi ( Lloyds ). They contacted me first to verify about my discharge, I sent them a copy of discharge letter and I received the funds last year. As BDO know about my husbands I don't think they will give up lightly....
