I am currently in a bankruptcy which has another 2.5 years to run and I make a contribution every month . At the moment I am providing care to a family member and working full time however my mental health is terrible and I just seem to go from one stressful situation to another . One option I am looking at is reducing hours at work in order to be able to provide care for my family member ( am their only family ) but would a trustee allow a reduced contribution ? I feel like Iโm in a vicious cycle where I got into debt then stressed about it but having the bankruptcy hanging over me when I am struggling to keep everything going is really hard .
Hi 1985debt.
Your bankruptcy payment is based upon affordability so, all other things being equal, your payment would reduce if your income fell. One key advantage of bankruptcy versus a trust deed is that the potential consequences of becoming unable to make any payment are much less of a worry.
Managing your health and wellbeing should clearly be your priority and I wish you well with this.
Afternoon 1985debt
As TDA advised, your debtor contribution order is based on your ability to afford a payment.
If you have a reduction in hours, then it is likely your monthly contribution can be varied to a lower payment or a nil payment.
Please speak with your Trustee and ask for a reassessment of your contribution.
Hope this helps
Thanks folks
