Hi
I have been in a trust deed for three years. I was told that I could do a fourth year in Luis of releasing equity on my home due to difficulties with poor credit rating, will I be forced to sell my home next year

What's your current monthly payment?

Hi babs,

Equity is a big factor and unfortunately from time to time can cause issues in Trust Deed's if not dealt with correctly and outlined in writing at the start.

Normally in a Trust Deed if someone has for example £4,200 of equity in their property then at the end of the 3 years they can extend their payments to pay this over which would be £350 x 12 months. If the equity is a lot more then a client needs to pay an increased payment to try and cover this.

In terms of being forced to sell your home, this is something that would only be considered as a last resort and if you have a large amount of equity which you had no way of paying or even paying a proportion of it. I can't remember the last time I had to sell a house under a Trust Deed.

I would suggest contacting your Trustee and asking them to confirm exactly how much equity your property has and make sure you receive this in writing. Once we know this we can then give you a better idea of your options.
